국민연금법 제77조(반환일시금)
National Pension Act, Article 77 (Lump-Sum Refund)
① 가입자 또는 가입자였던 자가 다음 각 호의 어느 하나에 해당하게 되면 본인이나 그 유족의 청구에 의하여 반환일시금을 지급받을 수 있다. <개정 2016.5.29>
(1) Where an insured person or former insured person comes to fall under any of the following subparagraphs, a lump-sum refund may be paid upon a claim by the person or his or her survivors:
1. 가입기간이 10년 미만인 자가 60세가 된 때
1. When a person whose insured period is less than 10 years reaches the age of 60;
2. 가입자 또는 가입자였던 자가 사망한 때. 다만, 제72조에 따라 유족연금이 지급되는 경우에는 그러하지 아니하다.
2. When an insured person or former insured person dies: Provided, That this shall not apply where a survivors' pension is paid under Article 72;
3. 국적을 상실하거나 국외로 이주한 때
3. When the person loses Korean nationality or emigrates abroad.
② 제1항에 따른 반환일시금의 액수는 가입자 또는 가입자였던 자가 납부한 연금보험료(사업장가입자 또는 사업장가입자였던 자의 경우에는 사용자의 부담금을 포함한다)에 대통령령으로 정하는 이자를 더한 금액으로 한다.
(2) The amount of the lump-sum refund under paragraph (1) shall be the pension contributions paid by the insured person or former insured person (including the employer contribution in the case of a workplace-based insured person or former workplace-based insured person), plus interest prescribed by Presidential Decree.
③ 제1항에 따라 반환일시금의 지급을 청구할 경우 유족의 범위와 청구의 우선순위 등에 관하여는 제73조를 준용한다.
(3) Article 73 shall apply mutatis mutandis to the scope of survivors, the order of priority for claims, and other matters where payment of a lump-sum refund is claimed under paragraph (1).
