국민연금법 제19조의2(실업에 대한 가입기간 추가 산입)

① 다음 각 호의 요건을 모두 갖춘 사람이 「고용보험법」 제37조제1항에 따른 구직급여를 받는 경우로서 구직급여를 받는 기간을 가입기간으로 산입하기 위하여 국민연금공단에 신청하는 때에는 그 기간을 가입기간에 추가로 산입한다. 다만, 추가로 산입하는 기간은 1년을 초과할 수 없다.

② 제1항에 따라 산입되는 가입기간에 대하여는 「고용보험법」 제45조에 따른 구직급여의 산정 기초가 되는 임금일액을 월액으로 환산한 금액의 절반에 해당하는 소득(이하 이 조에서 "인정소득"이라 한다)으로 가입한 것으로 본다. 다만, 인정소득의 상한선 및 하한선은 보건복지부장관이 정하여 고시하는 금액으로 한다.

③ 가입자 또는 가입자였던 사람은 제1항에 따라 구직급여를 받는 기간을 가입기간으로 추가 산입하려는 경우 인정소득을 기준으로 연금보험료를 납부하여야 한다. 이 경우 국가는 연금보험료의 전부 또는 일부를 일반회계, 제101조에 따른 국민연금기금 및 「고용보험법」 제78조에 따른 고용보험기금에서 지원할 수 있다.

④ 제1항에 따라 추가로 산입된 가입기간(이하 이 항에서 "추가산입기간"이라 한다)을 제49조제1호부터 제3호까지의 급여에 적용할 때에는 다음 각 호를 따른다.

⑤ 국민연금공단은 제1항에 따른 신청의 접수ㆍ처리 등 업무를 대통령령으로 정하는 바에 따라 「고용보험법」에 따른 직업안정기관 및 그 밖의 공공기관(「공공기관의 운영에 관한 법률」에 따른 공공기관을 말한다)에 위탁할 수 있다.

⑥ 제1항에 따른 신청방법, 제3항에 따른 지원 범위 및 내용 등에 필요한 사항은 대통령령으로 정한다.
