① 주민등록이 되어 있는 사람으로서 다음 각 호의 어느 하나에 해당하여 외국에서 투표하려는 투표권자는 서면ㆍ전자우편 또는 중앙선거관리위원회 홈페이지를 통하여 관할 구ㆍ시ㆍ군의 장에게 국외부재자신고를 하여야 한다. 이 경우 외국에 머물거나 거주하는 사람은 공관을 경유하여 신고하여야 한다.

② 주민등록이 되어 있지 아니하고 「공직선거법」 제218조의13에 따른 재외선거인명부에 올라 있지 아니한 사람으로서 외국에서 투표하려는 투표권자는 다음 각 호의 어느 하나에 해당하는 방법으로 중앙선거관리위원회에 재외투표인 등록신청을 하여야 한다.
