Enforcement Decree of the Military Personnel Act, Article 43 (Requirements for Special Promotion, etc.)

① 법 제30조제1항에 따른 전사자ㆍ순직자 및 같은 조 제2항에 따른 군 복무 중 국가를 위하여 뚜렷한 공적을 세운 사람에 대해서는 다음 각 호의 구분에 따라 진급시키거나 임용할 수 있다. <개정 2025.9.18>

② 제1항에 따른 "군 복무 중 국가를 위하여 뚜렷한 공적을 세운 사람"은 중징계 처분(그 징계기록이 말소된 경우는 제외한다)을 받은 사실이 없는 등 국방부장관이 정하는 기준에 부합하는 사람으로서 다음 각 호의 어느 하나에 해당하는 사람으로 한다. 이 경우 제2호부터 제4호까지의 규정은 대령 이하 장교, 장교후보생, 부사관, 부사관후보생 및 병을 대상으로 한다. <개정 2025.9.18>
