도로교통법 시행규칙 제33조의7(음주운전 방지장치의 등록 말소)

① 음주운전 방지장치 등록자 및 음주운전 방지장치가 부착된 자동차등의 소유자는 다음 각 호의 어느 하나에 해당하는 사유가 있는 경우 한국도로교통공단에 음주운전 방지장치의 등록 말소를 신청할 수 있다. 다만, 제3호의 사유에 해당하는 경우에는 그 사유가 발생한 날부터 30일 이내에 등록 말소를 신청해야 한다.

② 제1항에 따른 등록 말소를 신청하려는 자는 제1항 각 호의 사유를 증명할 수 있는 서류를 첨부하여 별지 제17호의8서식의 음주운전 방지장치 등록 말소 신청서를 한국도로교통공단에 제출해야 한다.

③ 한국도로교통공단은 다음 각 호의 어느 하나에 해당하는 경우에는 지체 없이 직권으로 음주운전 방지장치의 등록을 말소할 수 있다. 다만, 제1호의 사유에 해당하는 경우에는 음주운전 방지장치의 등록을 말소해야 한다.

④ 한국도로교통공단은 제1항에 따른 등록 말소를 신청한 사람이 원하는 경우 별지 제17호의9서식의 음주운전 방지장치 등록 말소 통보서를 발급할 수 있다. 이 경우 음주운전 방지장치 등록자와 음주운전 방지장치가 설치된 자동차등의 소유자가 다른 경우에는 소유자에게 등록 말소 사실을 알려야 한다.

⑤ 한국도로교통공단은 제3항에 따라 음주운전 방지장치의 등록을 말소한 경우 별지 제17호의9서식의 음주운전 방지장치 등록 말소 통보서에 따라 음주운전 방지장치 등록자에게 이를 알려야 한다. 이 경우 음주운전 방지장치 등록자와 음주운전 방지장치가 설치된 자동차등의 소유자가 다른 경우에는 소유자에게도 알려야 한다.
