민사집행법 제137조(차순위매수신고인에 대한 매각허가여부결정)

①차순위매수신고인이 있는 경우에 매수인이 대금지급기한까지 그 의무를 이행하지 아니한 때에는 차순위매수신고인에게 매각을 허가할 것인지를 결정하여야 한다. 다만, 제142조제4항의 경우에는 그러하지 아니하다.

②차순위매수신고인에 대한 매각허가결정이 있는 때에는 매수인은 매수신청의 보증을 돌려 줄 것을 요구하지 못한다.
