민사집행법 제41조(집행개시의 요건)

①반대의무의 이행과 동시에 집행할 수 있다는 것을 내용으로 하는 집행권원의 집행은 채권자가 반대의무의 이행 또는 이행의 제공을 하였다는 것을 증명하여야만 개시할 수 있다.

②다른 의무의 집행이 불가능한 때에 그에 갈음하여 집행할 수 있다는 것을 내용으로 하는 집행권원의 집행은 채권자가 그 집행이 불가능하다는 것을 증명하여야만 개시할 수 있다.
