보호관찰 등에 관한 법률 제32조(보호관찰 대상자의 준수사항)
Act on Probation, etc., Article 32 (Conditions to Be Observed by Probationers)
① 보호관찰 대상자는 보호관찰관의 지도ㆍ감독을 받으며 준수사항을 지키고 스스로 건전한 사회인이 되도록 노력하여야 한다.
(1) A probationer shall be under the guidance and supervision of a probation officer, observe the conditions imposed, and strive to become a sound member of society on his or her own.
② 보호관찰 대상자는 다음 각 호의 사항을 지켜야 한다.
(2) A probationer shall observe the following:
1. 주거지에 상주(常住)하고 생업에 종사할 것
1. To live permanently at his or her residence and engage in a livelihood;
2. 범죄로 이어지기 쉬운 나쁜 습관을 버리고 선행(善行)을 하며 범죄를 저지를 염려가 있는 사람들과 교제하거나 어울리지 말 것
2. To give up bad habits that easily lead to crime, to behave well, and not to associate or keep company with persons who are likely to commit crimes;
3. 보호관찰관의 지도ㆍ감독에 따르고 방문하면 응대할 것
3. To follow the guidance and supervision of the probation officer and to respond when the probation officer visits;
4. 주거를 이전(移轉)하거나 1개월 이상 국내외 여행을 할 때에는 미리 보호관찰관에게 신고할 것
4. To report to the probation officer in advance when moving residence or traveling in Korea or abroad for one month or longer.
③ 법원 및 심사위원회는 판결의 선고 또는 결정의 고지를 할 때에는 제2항의 준수사항 외에 범죄의 내용과 종류 및 본인의 특성 등을 고려하여 필요하면 보호관찰 기간의 범위에서 기간을 정하여 다음 각 호의 사항을 특별히 지켜야 할 사항으로 따로 과(科)할 수 있다.
(3) When pronouncing a judgment or giving notice of a decision, the court or the Review Committee may, in addition to the conditions under paragraph (2), separately impose any of the following as special conditions, for a period set within the probation period, if necessary in consideration of the nature and type of the crime and the characteristics of the person:
1. 야간 등 재범의 기회나 충동을 줄 수 있는 특정 시간대의 외출 제한
1. Restriction on going out during specific hours, such as at night, that may provide an opportunity or impulse to reoffend;
2. 재범의 기회나 충동을 줄 수 있는 특정 지역ㆍ장소의 출입 금지
2. Prohibition on entering specific areas or places that may provide an opportunity or impulse to reoffend;
3. 피해자 등 재범의 대상이 될 우려가 있는 특정인에 대한 접근 금지
3. Prohibition on approaching specific persons who are likely to become targets of reoffending, such as the victim;
4. 범죄행위로 인한 손해를 회복하기 위하여 노력할 것
4. To make efforts to restore the damage caused by the criminal act;
5. 일정한 주거가 없는 자에 대한 거주장소 제한
5. Restriction on place of residence for a person without a fixed residence;
6. 사행행위에 빠지지 아니할 것
6. Not to indulge in speculative acts;
7. 일정량 이상의 음주를 하지 말 것
7. Not to drink more than a certain amount of alcohol;
8. 마약 등 중독성 있는 물질을 사용하지 아니할 것
8. Not to use addictive substances such as narcotics;
9. 「마약류관리에 관한 법률」상의 마약류 투약, 흡연, 섭취 여부에 관한 검사에 따를 것
9. To submit to tests for whether he or she has administered, smoked, or ingested narcotics, etc. under the Act on the Control of Narcotics, etc.;
10. 그 밖에 보호관찰 대상자의 재범 방지를 위하여 필요하다고 인정되어 대통령령으로 정하는 사항
10. Other matters prescribed by Presidential Decree as found necessary to prevent the probationer from reoffending.
④ 보호관찰 대상자가 제2항 또는 제3항의 준수사항을 위반하거나 사정변경의 상당한 이유가 있는 경우에는 법원은 보호관찰소의 장의 신청 또는 검사의 청구에 따라, 심사위원회는 보호관찰소의 장의 신청에 따라 각각 준수사항의 전부 또는 일부를 추가, 변경하거나 삭제할 수 있다. <개정 2019.4.16>
(4) If a probationer violates the conditions under paragraph (2) or (3), or if there are substantial reasons due to a change in circumstances, the court, upon an application by the head of a probation office or a request by a prosecutor, and the Review Committee, upon an application by the head of a probation office, may add to, change, or delete all or part of the conditions.
⑤ 제2항부터 제4항까지의 준수사항은 서면으로 고지하여야 한다.
(5) The conditions under paragraphs (2) through (4) shall be notified in writing.
