부패방지 및 국민권익위원회의 설치와 운영에 관한 법률 시행령 제16조(위원회 의결 등)
Enforcement Decree of the Act on the Prevention of Corruption and the Establishment and Operation of the Anti-Corruption and Civil Rights Commission, Article 16 (Resolutions of the Commission, etc.)
① 위원회는 다음 각 호의 사항을 심의ㆍ의결한다. <개정 2011.10.17, 2016.9.27, 2020.12.22, 2022.7.19>
(1) The Commission shall deliberate and resolve the following matters:
1. 위원회의 주요정책 결정 및 운영에 관한 사항
1. Matters concerning decisions on major policies and operation of the Commission;
2. 법 제46조에 따른 시정을 권고하는 사항 중 제18조 각 호에 해당하는 사항
2. Among matters for recommending corrective measures under Article 46 of the Act, matters falling under the subparagraphs of Article 18;
3. 법 제47조에 따른 제도개선을 권고하는 사항
3. Matters for recommending institutional improvement under Article 47 of the Act;
4. 법 제51조제1항에 따른 감사의뢰의 결정에 관한 사항
4. Matters concerning decisions on requesting audits under Article 51 (1) of the Act;
5. 위원회의 종전 의결례를 변경할 필요가 있는 사항
5. Matters for which it is necessary to change a previous resolution precedent of the Commission;
6. 소위원회가 위원회에서 직접 처리하도록 의결한 사항
6. Matters that a subcommittee has resolved to have the Commission handle directly;
7. 부패방지 또는 부패행위 신고사항 등과 관련하여 위원장이 정하는 사항
7. Matters determined by the chairperson in relation to corruption prevention or reports of corrupt acts, etc.;
8. 「공익신고자 보호법」에 따른 공익신고 사항 등과 관련하여 위원장이 정하는 사항
8. Matters determined by the chairperson in relation to public interest reports, etc. under the Public Interest Whistleblower Protection Act;
8의2. 「부정청탁 및 금품등 수수의 금지에 관한 법률」에 따른 위반행위 신고사항 등과 관련하여 위원장이 정하는 사항
8-2. Matters determined by the chairperson in relation to reports of violations, etc. under the Act on Prohibition of Improper Solicitation and Provision of Money and Valuables;
8의3. 「공공재정 부정청구 금지 및 부정이익 환수 등에 관한 법률」에 따른 신고사항 등과 관련하여 위원장이 정하는 사항
8-3. Matters determined by the chairperson in relation to reports, etc. under the Act on Prohibition against Fraudulent Claims for Public Finances and Recovery of Illicit Gains;
9. 그 밖에 위원회에서 처리하는 것이 필요하다고 위원장이 인정하는 사항
9. Other matters that the chairperson deems necessary to be handled by the Commission.
② 위원회의 회의는 정례적으로 개최하되, 필요하다고 인정되는 경우에는 위원장이 수시로 소집할 수 있다.
(2) Meetings of the Commission shall be held regularly, and the chairperson may convene them from time to time where deemed necessary.
③ 위원회의 회의는 위원이 동영상과 음성이 동시에 송수신되는 장치가 갖추어진 서로 다른 장소에 출석하여 진행하는 원격영상회의 방식으로 할 수 있다. 이 경우 위원이 동일한 회의장에 출석한 것으로 본다. <신설 2018.1.30>
(3) Meetings of the Commission may be held by remote video conference, in which members attend from different places equipped with devices that simultaneously transmit and receive video and audio. In such cases, members are deemed to have attended the same meeting place.
