사립학교법 제10조(설립허가)

① 학교법인을 설립하려는 자는 일정한 재산을 출연하고, 다음 각 호의 사항을 적은 정관을 작성하여 대통령령으로 정하는 바에 따라 교육부장관의 허가를 받아야 한다. 이 경우 기술대학을 설치ㆍ경영하는 학교법인을 설립할 때에는 대통령령으로 정하는 바에 따라 미리 산업체가 일정한 재산을 출연하여야 한다.

② 학교법인의 설립 당초의 임원은 정관으로 정하여야 한다.

③ 제1항제6호의 사항을 정할 때 기술대학을 설치ㆍ경영하는 학교법인의 경우에는 대통령령으로 정하는 바에 따라 산업체에 근무하는 사람을 임원으로 포함하여야 한다.
