새만금사업 추진 및 지원에 관한 특별법 제46조(토지ㆍ건물 등의 사용허가등의 특례)

① 국가 및 지방자치단체는 필요하다고 인정하는 경우 외국인투자기업, 협력기업, 외국교육기관, 외국의료기관 및 그 밖에 새만금사업지역에 입주하는 기업과 연구기관으로서 대통령령으로 정하는 기업과 연구기관에 대하여 대통령령으로 정하는 새만금사업지역의 국공유 토지 또는 건물 등을 「국유재산법」 제35조ㆍ제46조 및 「공유재산 및 물품 관리법」 제21조ㆍ제31조에도 불구하고 50년의 범위에서 사용허가등을 할 수 있다. 이 경우 사용허가등의 기간을 50년의 범위에서 연장할 수 있다. <개정 2015.8.11, 2016.12.2, 2020.1.29>

② 제1항에 따라 토지의 사용허가등을 받은 자는 「국유재산법」 제18조 및 「공유재산 및 물품 관리법」 제13조에도 불구하고 사용허가등을 받은 토지 위에 공장 또는 그 밖에 필요한 영구시설물을 축조할 수 있다. 이 경우 국가 및 지방자치단체는 해당 시설물의 종류 등을 고려하여 사용허가등의 기간이 종료되는 때에 이를 국가 및 지방자치단체에 기부하거나 원상회복하여 반환하는 조건을 붙여야 한다. <개정 2015.8.11>
