새만금사업 추진 및 지원에 관한 특별법 시행령 제10조(개발계획의 수립 등)
Enforcement Decree of the Special Act on Promotion of and Support for the Saemangeum Project, Article 10 (Formulation of Development Plans, etc.|27)
① 법 제9조제1항제12호에서 "대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2016.2.11, 2016.12.30, 2021.1.5, 2024.5.7>
(1) The term "matters prescribed by Presidential Decree" in Article 9 (1) 12 of the Act means the following:
1. 개발계획이 명시된 지형도 또는 지적도
1. A topographic map or cadastral map showing the development plan;
2. 도시방재계획
2. An urban disaster prevention plan;
3. 도시정보화계획
3. An urban informatization plan;
4. 공동구(共同溝) 등 지하매설물계획
4. A plan for underground utilities such as common utility conduits;
5. 집단에너지공급에 관한 계획
5. A plan for district energy supply;
6. 국가유산보호계획
6. A national heritage protection plan;
7. 채석장 및 취토장 확보계획
7. A plan for securing quarries and borrow pits;
8. 용도별 토지의 수요 및 경제성 분석
8. An analysis of demand and economic feasibility of land by use;
9. 그 밖에 새만금청장이 법 제12조에 따른 관계법률등(이하 "관계법률등"이라 한다)에 따라 필요하다고 인정하는 사항
9. Other matters that the Commissioner of the Saemangeum Agency deems necessary under the relevant statutes, etc. under Article 12 of the Act (hereinafter referred to as "relevant statutes, etc.").
② 법 제9조제2항 후단에서 "대통령령으로 정하는 중요한 사항"이란 다음 각 호의 어느 하나에 해당하는 사항을 말한다. 이 경우 제1호부터 제3호까지는 누적 변경의 합이 해당 호에서 정하는 기준에 해당하는 경우를 포함한다. <개정 2016.2.11>
(2) The term "important matters prescribed by Presidential Decree" in the latter part of Article 9 (2) of the Act means any of the following. In this case, subparagraphs 1 through 3 include cases where the sum of cumulative changes meets the standard prescribed in the relevant subparagraph:
1. 개발면적의 100분의 10 또는 100만제곱미터를 초과하는 변경
1. A change exceeding 10/100 of the development area or 1 million square meters;
2. 법 제9조제1항제5호에 따른 토지이용계획의 변경으로서 개발계획에서 분류한 용도지역의 해당 용도별 면적의 100분의 10을 초과하는 변경
2. A change in the land use plan under Article 9 (1) 5 of the Act that exceeds 10/100 of the area by use of the use areas classified in the development plan;
3. 사업비의 100분의 10을 초과하는 재원조달계획의 변경
3. A change in the fund-raising plan exceeding 10/100 of the project cost;
4. 사업시행자의 변경
4. A change of the project implementer.
③ 새만금청장은 법 제9조제5항에 따라 개발계획을 승인하거나 변경승인하였을 때에는 다음 각 호의 사항을 관보에 고시하여야 한다. <개정 2016.2.11, 2017.6.2>
(3) When the Commissioner of the Saemangeum Agency has approved or approved a change of a development plan under Article 9 (5) of the Act, the Commissioner shall publicly notify the following in the Official Gazette:

2. An outline of the project plan;
3. 사업 시행기간 및 단계별 시행계획
3. The project implementation period and phased implementation plan;
4. 사업비

7. 사업시행자의 성명(법인인 경우에는 법인의 명칭 및 대표자의 성명)ㆍ주소
7. The name (the name of the corporation and the name of its representative, in the case of a corporation) and address of the project implementer;
8. 변경 사유(변경하는 경우만 해당한다)
8. The reasons for the change (only in the case of a change);
9. 관계 도서(圖書)의 열람 방법
9. The method of inspecting the relevant documents;
10. 그 밖에 새만금청장이 관계법률등에 따라 필요하다고 인정하는 사항
10. Other matters that the Commissioner of the Saemangeum Agency deems necessary under the relevant statutes, etc.
④ 관계 지방자치단체의 장은 법 제9조제5항에 따라 승인된 개발계획의 관계 서류 사본을 송부받은 날부터 30일 이상 일반인이 그 내용을 열람할 수 있도록 하여야 한다. <개정 2017.6.2>
(4) The head of a relevant local government shall allow the general public to inspect the contents of the approved development plan for at least 30 days from the date of receiving a copy of the relevant documents of the development plan approved under Article 9 (5) of the Act.
