소방시설 설치 및 관리에 관한 법률 제12조(특정소방대상물에 설치하는 소방시설의 관리 등)

① 특정소방대상물의 관계인은 대통령령으로 정하는 소방시설을 화재안전기준에 따라 설치ㆍ관리하여야 한다. 이 경우 「장애인ㆍ노인ㆍ임산부 등의 편의증진 보장에 관한 법률」 제2조제1호에 따른 장애인등이 사용하는 소방시설(경보설비 및 피난구조설비를 말한다)은 대통령령으로 정하는 바에 따라 장애인등에 적합하게 설치ㆍ관리하여야 한다.

② 소방본부장이나 소방서장은 제1항에 따른 소방시설이 화재안전기준에 따라 설치ㆍ관리되고 있지 아니할 때에는 해당 특정소방대상물의 관계인에게 필요한 조치를 명할 수 있다.

③ 특정소방대상물의 관계인은 제1항에 따라 소방시설을 설치ㆍ관리하는 경우 화재 시 소방시설의 기능과 성능에 지장을 줄 수 있는 폐쇄(잠금을 포함한다. 이하 같다)ㆍ차단 등의 행위를 하여서는 아니 된다. 다만, 소방시설의 점검ㆍ정비를 위하여 필요한 경우 폐쇄ㆍ차단은 할 수 있다.

④ 소방청장, 소방본부장 또는 소방서장은 제1항에 따른 소방시설의 작동정보 등을 실시간으로 수집ㆍ분석할 수 있는 시스템(이하 "소방시설정보관리시스템"이라 한다)을 구축ㆍ운영할 수 있다.

⑤ 소방청장, 소방본부장 또는 소방서장은 제4항에 따른 작동정보를 해당 특정소방대상물의 관계인에게 통보하여야 한다.

⑥ 소방시설정보관리시스템 구축ㆍ운영의 대상은 「화재의 예방 및 안전관리에 관한 법률」 제24조제1항 전단에 따른 소방안전관리대상물 중 소방안전관리의 취약성 등을 고려하여 대통령령으로 정하고, 그 밖에 운영방법 및 통보 절차 등에 필요한 사항은 행정안전부령으로 정한다.
