식품위생법 제31조의3(자가품질검사의 확인검사)

① 제31조제2항에 따라 자가품질검사를 위탁하여 실시한 영업자가 「식품ㆍ의약품분야 시험ㆍ검사 등에 관한 법률」 제11조제3항에 따라 부적합으로 통보받은 검사 결과에 이의가 있으면 자가품질검사를 실시한 제품과 같은 제품(같은 날에 같은 영업시설에서 같은 제조 공정을 통하여 제조ㆍ생산된 제품에 한정한다. 이하 이 조에서 같다)에 대한 확인검사를 2곳 이상의 다른 「식품ㆍ의약품분야 시험ㆍ검사 등에 관한 법률」 제6조제2항제1호에 따른 식품 등 시험ㆍ검사기관에 요청할 수 있다. 이 경우 영업자는 식품의약품안전처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 확인검사 요청 사실을 지체 없이 보고하여야 한다.

② 제1항에 따라 확인검사를 요청받은 식품 등 시험ㆍ검사기관은 자가품질검사를 실시한 제품과 같은 제품에 대하여 같은 검사 항목, 기준 및 방법에 따라 확인검사를 실시한 후 영업자에게 시험ㆍ검사성적서를 발급하여야 한다. 다만, 시간이 경과함에 따라 검사 결과가 달라질 수 있는 검사항목 등 총리령으로 정하는 검사항목은 확인검사 대상에서 제외한다.

③ 제2항에 따라 시험ㆍ검사성적서를 발급받은 영업자는 해당 시험ㆍ검사의 결과가 모두 적합인 경우에는 관할 지방식품의약품안전청장에게 그 시험ㆍ검사성적서를 첨부하여 최종 확인검사를 요청할 수 있다. 이 경우 확인검사에 드는 비용은 영업자가 부담한다.

④ 제3항에 따라 최종 확인검사를 요청받은 지방식품의약품안전청장은 제2항에 따른 검사 항목, 기준 및 방법에 따라 검사를 실시하고 영업자에게 시험ㆍ검사성적서를 발급하여야 한다.

⑤ 식품의약품안전처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따른 확인검사를 요청한 영업자가 제4항에 따른 검사 결과 적합으로 판정된 시험ㆍ검사성적서를 제출하는 경우에는 제45조에 따른 회수조치, 제73조제1항에 따른 공표 명령을 철회하는 등 지체없이 필요한 조치를 하여야 한다.

⑥ 제1항에 따른 확인검사 요청ㆍ보고 절차, 제2항에 따른 시험검사성적서의 발급, 제3항에 따른 최종 확인검사의 요청 및 제4항에 따른 지방식품의약품안전청장의 시험ㆍ검사성적서 발급 등에 필요한 사항은 총리령으로 정한다.
