야생생물 보호 및 관리에 관한 법률 제22조의7(영업의 승계)

① 야생동물 영업자가 그 영업을 양도하거나 사망하였을 때 또는 법인의 합병이 있을 때에는 그 양수인ㆍ상속인 또는 합병 후 존속하는 법인이나 합병으로 설립되는 법인(이하 "양수인등"이라 한다)은 그 야생동물 영업자의 지위를 승계한다.

② 다음 각 호의 어느 하나에 해당하는 절차에 따라 영업시설의 전부를 인수한 자는 그 야생동물 영업자의 지위를 승계한다. 이 경우 종전의 야생동물 영업 허가는 그 효력을 잃는다.

③ 제1항 또는 제2항에 따라 야생동물 영업자의 지위를 승계한 자는 승계한 날부터 30일 이내에 기후에너지환경부령으로 정하는 바에 따라 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2025.10.1>

④ 제1항 또는 제2항에 따라 야생동물 영업자의 지위를 승계한 자의 결격사유에 관하여는 제22조의6을 준용한다. 다만, 상속인이 제22조의6제1호에 해당하는 경우에는 상속을 받은 날부터 3개월 동안은 그러하지 아니하다.

⑤ 제22조의9제1항 또는 제2항에 따른 처분을 받은 경우 그 처분의 효과는 그 처분기간이 만료된 날부터 1년간 양수인등에게 승계되며, 처분의 절차가 진행 중일 때에는 양수인등에 대하여 처분 절차를 계속 진행할 수 있다. 다만, 양수인등이 양수ㆍ상속 또는 합병 시에 그 처분 또는 위반사실을 알지 못하였음을 증명하는 경우에는 그러하지 아니하다.
