여객자동차 운수사업법 제16조(여객자동차운송사업의 휴업ㆍ폐업)

① 제4조제1항에 따라 여객자동차운송사업의 면허를 받은 자는 그 사업의 전부 또는 일부를 휴업하거나 그 사업의 전부를 폐업하려면 국토교통부령으로 정하는 바에 따라 국토교통부장관 또는 시ㆍ도지사의 허가를 받아야 한다. 다만, 도로나 다리가 파괴되거나 그 밖에 정당한 사유가 있는 경우에는 그러하지 아니하다. <개정 2013.3.23>

② 제4조제1항 단서에 따라 여객자동차운송사업의 등록을 한 자는 그 사업의 전부 또는 일부를 휴업하거나 그 사업의 전부를 폐업하려면 국토교통부령으로 정하는 바에 따라 시ㆍ도지사에게 신고하여야 한다. <개정 2013.3.23>

③ 국토교통부장관 또는 시ㆍ도지사는 제2항에 따른 신고를 받은 날부터 국토교통부령으로 정하는 기간 내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.3.21>

④ 국토교통부장관 또는 시ㆍ도지사가 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장 여부를 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2017.3.21>

⑤ 제1항과 제2항의 휴업 기간은 1년을 넘지 못한다. <개정 2017.3.21>

⑥ 운송사업자는 그 사업의 전부 또는 일부를 휴업하거나 그 사업의 전부를 폐업하려면 미리 그 취지를 영업소와 일반 사람들이 보기 쉬운 곳에 게시하여야 한다. <개정 2017.3.21>
