Enforcement Decree of the Nuclear Safety Act, Article 136 (Hazard Prevention Measures and Reports)
(1) Safety measures that a nuclear business operator must take under Article 92 (1) of the Act are as follows:
1. Where the safety of nuclear utilization facilities is threatened or radiation workers are threatened in performing duties related to safe operation due to disasters such as earthquakes, fires, floods, typhoons, and toxic gas leaks, the operator shall remove the cause and take measures to prevent the spread of damage;
2. Where the safety of nuclear utilization facilities is threatened due to failure, etc. of nuclear utilization facilities, etc., the operator shall remove the cause of the failure, etc. and restore them to a normal state: Provided, That where normal restoration is impossible, the operator shall take measures to prevent the spread of the failure, etc.; and
3. Where radioactive material abnormally leaks and the concentration in air or water at the facility boundary (the restricted area boundary where one has been established) exceeds the limit value under the discharge management standards determined by the Commission, or radiation workers or occasional entrants are exposed in excess of the dose limit, the operator shall take the following measures:
(a) Evacuation warnings to persons inside or near the nuclear utilization facilities and restricted area;
(b) Emergency measures such as rescue and evacuation of persons who suffered or are likely to suffer radiation hazards;
(c) Where contamination by radioactive material, etc. has occurred, prevention of the spread of contamination and decontamination;
(d) Where there is room to move radioactive material, etc. to another place, relocation to a safe place, installation of signs prescribed by Commission Rule around the place, and prohibition of entry or approach by persons other than those concerned; and
(e) Where emergency radiation work is performed, prevention of radiation exposure of persons engaged in emergency work in excess of the standards determined by the Commission, through use of appropriate protective equipment and shortening of radiation exposure time.
(2) When a nuclear business operator has taken the safety measures in paragraph (1), the operator shall report the following to the Commission, as determined by the Commission:
1. The date, time, and place of occurrence of the situation under Article 92 (1) of the Act and its cause;
2. The status of radiation hazards that have occurred or are likely to occur; and
3. The content and plan of the safety measures.
(3) The Commission may provide specialized training on radiation emergency relief, as determined and publicly notified by the Commission, to persons concerned with radiation emergency medical relief who take emergency measures under paragraph (1) 3 (b).
