Enforcement Decree of the Early Childhood Education Act, Article 17 (Young Child Placement Plans)

① 교육감은 유치원에 취학하기를 희망하는 유아의 적정한 배치를 위하여 3년마다 취학권역별로 3개 학년도 이상의 유아배치계획을 수립해야 한다. <개정 2019.8.6>

② 제1항에 따른 취학권역은 취학 대상 유아의 거주분포 등을 고려하여 교육감이 정한다. 다만, 취학 대상 유아는 거주지가 속한 취학권역 밖에 있는 유치원에 취학할 수 있다.

③ 교육감은 제1항에 따라 유아배치계획을 수립할 때에는 다음 각 호의 기준에 따라야 한다. <개정 2016.9.21, 2019.8.6>

(3) When웬 formulating^f포뮬레이팅 a어 young영 child차일드 placement플레이스먼트 plan플랜 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 superintendent수퍼^r런텐던트 of어^v브 education에저케이션 shall섈 comply컴플라이 with위^ð드 the^ð더 following^f팔로잉 standards:스탠더즈

1. 제17조의2에 따른 유치원 취학 수요조사 결과를 최대한 반영할 것

2. 다음 각 목의 어느 하나에 해당하는 경우에는 제1호에 따른 수요조사 결과와 관계없이 그 내용을 유아배치계획에 우선하여 포함시킬 것

가. 제29조제1항제3호에 따른 기관이 유치원으로 전환되는 경우

(a)어 Where웨어 an앤 institution인스티투션 under언더 Article아터클 29 (1) 3 is이즈 converted컨^v버티드 into인투 a어 kindergarten;킨더가튼

나. 유치원을 통폐합하는 경우

3. 도시개발사업, 택지개발사업 등으로 인구가 유입되어 초등학교를 신설하는 경우에는 신설되는 초등학교 정원의 4분의 1 이상에 해당하는 수의 유아를 배치할 수 있는 공립유치원의 설립계획을 유아배치계획에 포함시킬 것. 다만, 교육감은 해당 사업이 실시되는 취학권역 및 인근 취학권역에서의 다음 각 목의 사항을 고려하여 교육부장관이 정하는 범위에서 배치 대상 유아 수를 다르게 정할 수 있다.

⑤ 교육감은 제1항에 따른 유아배치계획을 수립한 때에는 즉시 취학권역별 사립유치원 설립 가능 여부를 해당 교육청의 게시판 또는 인터넷 홈페이지 등을 통하여 공고해야 한다. <신설 2015.1.6, 2019.8.6>
