자동차관리법 제31조의3(자동차 사고조사)

① 성능시험대행자는 화재 등 국토교통부령으로 정하는 자동차사고가 제31조제1항에 따른 결함으로 인하여 발생한 것으로 의심되는 경우에는 사고의 원인을 규명하기 위한 조사(이하 "사고조사"라 한다)를 할 수 있다. 이 경우 국토교통부장관은 사고조사에 필요한 시설, 장비 및 조사에 드는 비용을 지원하여야 한다.

② 성능시험대행자는 사고조사를 위하여 필요한 경우에는 소유자, 운전자, 보관자 및 그 밖의 관계인에게 질문을 하거나 자료 제출, 해당 자동차 또는 부품의 보존, 대여 또는 매입을 요청할 수 있다.

③ 제2항에 따른 요청을 받은 자가 자동차 또는 부품의 보존, 대여 또는 매입에 응하는 경우 성능시험대행자는 국토교통부령으로 정하는 기준에 따라 정당한 대가를 지급하여야 한다.

④ 성능시험대행자는 사고조사를 신속하고 원활하게 수행하기 위하여 경찰청, 소방청 등 관계 기관의 장에게 사고현장 출입, 자동차 또는 부품의 보존 등 사고조사에 필요한 협조를 요청할 수 있다. 이 경우 관계 기관의 장은 정당한 사유가 없으면 이에 응하여야 한다.

⑤ 성능시험대행자는 사고조사를 하는 경우 지방자치단체, 경찰청, 소방청, 「보험업법」에 따른 보험회사 및 보험요율 산출기관, 그 밖의 관계 기관 등에 대통령령으로 정하는 자료를 제공하여 줄 것을 요청할 수 있다. 이 경우 자료의 제공을 요청받은 자는 정당한 사유가 없으면 이에 응하여야 한다.
