자동차손해배상 보장법 제37조(자동차사고 피해지원사업 분담금)

① 제5조제1항에 따라 책임보험등에 가입하여야 하는 자와 제5조제4항에 따른 자동차 중 대통령령으로 정하는 자동차보유자는 자동차사고 피해지원사업 및 관련 사업을 위한 분담금을 국토교통부장관에게 내야 한다. <개정 2013.8.6, 2016.12.20>

② 제1항에 따른 분담금은 책임보험등의 보험료(책임공제의 경우에는 책임공제분담금을 말한다)에 해당하는 금액의 100분의 5를 초과하지 아니하는 범위에서 대통령령으로 정한다. <신설 2022.11.15>

③ 제1항에 따라 분담금을 내야 할 자 중 제5조제1항에 따라 책임보험등에 가입하여야 하는 자의 분담금은 책임보험등의 계약을 체결하는 보험회사등이 해당 납부 의무자와 계약을 체결할 때에 징수하여 정부에 내야 한다. <개정 2022.11.15>

④ 국토교통부장관은 제30조제1항제1호 및 제2호의 경우에 해당하는 사고를 일으킨 자에게는 제1항에 따른 분담금의 3배의 범위에서 대통령령으로 정하는 바에 따라 분담금을 추가로 징수할 수 있다. <신설 2016.3.22, 2020.6.9, 2022.11.15>
