장애인복지법 제59조(장애인복지시설 설치)

①국가와 지방자치단체는 장애인복지시설을 설치할 수 있다.

②제1항에 규정된 자 외의 자가 장애인복지시설을 설치ㆍ운영하려면 해당 시설 소재지 관할 시장ㆍ군수ㆍ구청장에게 신고하여야 하며, 신고한 사항 중 보건복지부령으로 정하는 중요한 사항을 변경할 때에도 신고하여야 한다. 다만, 제62조에 따른 폐쇄 명령을 받고 1년이 지나지 아니한 자는 시설의 설치ㆍ운영 신고를 할 수 없다. <개정 2008.2.29, 2010.1.18>

③ 시장ㆍ군수ㆍ구청장은 제2항에 따른 신고 또는 변경신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고 또는 변경신고를 수리하여야 한다. <신설 2019.1.15>

④ 제58조제1항제1호에 따른 장애인 거주시설의 정원은 30명을 초과할 수 없다. 다만, 특수한 서비스를 위하여 일정 규모 이상이 필요한 시설 등 대통령령으로 정하는 경우에는 그러하지 아니하다. <신설 2011.3.30, 2019.1.15>

⑤제58조제1항제4호에 따른 의료재활시설의 설치는 「의료법」에 따른다. <개정 2011.3.30, 2019.1.15>
