재산형 등에 관한 군검찰 집행사무규칙 제36조(벌과금 등 집행의 촉탁)

① 군검사는 벌과금 등의 납부명령을 받고도 납부하지 아니한 납부의무자가 다른 군검찰부 관할로 전출되거나 전역(轉役) 또는 제적되었을 때에는 납부의무자의 소속 부대 또는 기관의 소재지를 관할하는 군검찰부 군검사나 현재지ㆍ주거지 또는 재산소재지를 관할하는 지방공소청 또는 지방공소청 지청(支廳)의 검사에게 별지 제38호서식의 벌과금 등 집행촉탁서에 재판서 또는 재판과 같은 효력을 갖는 조서의 등본 또는 초본, 벌과금 등 원표 등 관계 자료를 첨부하여 벌과금 등의 집행을 촉탁할 수 있다. <개정 2023.4.27, 2026.10.2>

② 제1항에 따라 군검사가 벌과금 등의 집행을 촉탁한 경우 검찰서기는 별지 제45호서식의 벌과금 등 집행촉탁부에 필요한 사항을 적어야 한다. <개정 2023.4.27>

③ 제1항에 따른 집행의 촉탁은 징수금의 시효가 완성되기 3개월 전까지 하여야 한다. 다만, 시효가 완성되기 직전까지 집행할 수 있는 명백한 사정이 있는 경우에는 그러하지 아니하다.
