전기사업법 제31조의2(산지에 설치되는 재생에너지 설비의 전력거래)

① 「산지관리법」 제2조제1호에 따른 산지에 「재생에너지 개발ㆍ이용ㆍ보급 촉진법」 제2조제2호가목 및 나목에 해당하는 재생에너지 설비를 설치하여 전력거래를 하려는 발전사업자는 「산지관리법」 제39조제2항에 따른 중간복구명령(이에 따른 복구준공검사를 포함한다)이 있는 경우 이를 전력거래 전에 완료하여야 한다. <개정 2026.3.17>

② 기후에너지환경부장관은 제1항의 발전사업자가 중간복구를 완료하지 아니하고 전력거래를 한 경우로서 「산지관리법」 제41조의2제2항에 따라 산림청장등이 사업정지를 요청하는 경우에는 중간복구준공이 완료될 때까지 사업정지를 명할 수 있다. <개정 2025.10.1>

③ 제2항에도 불구하고 기후에너지환경부장관은 계절적 요인으로 복구준공이 불가피하게 지연되거나 부분 복구준공이 가능한 경우 등 대통령령으로 정하는 사유가 있는 때에는 6개월의 범위에서 사업정지 명령을 유예할 수 있다. <개정 2025.10.1>
