전기통신사업법 제65조(목적 외 사용의 제한 등)

① 자가전기통신설비를 설치한 자는 그 설비를 이용하여 타인의 통신을 매개하거나 설치한 목적에 어긋나게 운용하거나 제64조제1항에 따라 신고 또는 변경신고한 사항과 다르게 운용하여서는 아니 된다. 다만, 다른 법률에 특별한 규정이 있거나 그 설치 목적에 어긋나지 아니하는 범위에서 다음 각 호의 어느 하나에 해당하는 용도에 사용하는 경우에는 그러하지 아니하다. <개정 2013.3.23, 2017.7.26, 2023.7.18>

② 자가전기통신설비를 설치한 자는 대통령령으로 정하는 바에 따라 관로ㆍ선조 등의 전기통신설비를 기간통신사업자에게 제공할 수 있다.

③ 제2항에 따른 설비의 제공에 관하여는 제35조ㆍ제44조(같은 조 제6항은 제외한다)ㆍ제45조부터 제47조까지의 규정을 준용한다. <개정 2014.10.15>

④ 과학기술정보통신부장관은 자가전기통신설비를 설치한 자가 제1항을 위반한 경우에는 1년 이내의 기간을 정하여 그 사용의 정지를 명할 수 있다. 이 경우 과학기술정보통신부장관은 사용정지를 명한 사실을 해당 소재지를 관할하는 시ㆍ도지사에게 통지하여야 한다. <신설 2015.12.1, 2017.7.26>

⑤ 과학기술정보통신부장관은 대통령령으로 정하는 바에 따라 자가전기통신설비에 관한 점검을 실시할 수 있다. <신설 2023.7.18>
