전자상거래 등에서의 소비자보호에 관한 법률 제5조(전자문서의 활용)

① 「전자문서 및 전자거래 기본법」 제6조제2항제2호에도 불구하고 사업자가 소비자와 미리 전자문서로 거래할 것을 약정하여 지정한 주소(「전자문서 및 전자거래 기본법」 제2조제2호의 정보처리시스템을 말한다)로 전자문서(「전자문서 및 전자거래 기본법」 제2조제1호에 따른 전자문서를 말한다. 이하 같다)를 송신하지 아니한 경우에는 그 사업자는 해당 전자문서에 의한 권리를 주장할 수 없다. 다만, 긴급한 경우, 소비자도 이미 전자문서로 거래할 것을 예정하고 있는 경우, 소비자가 전자문서를 출력한 경우 등 대통령령으로 정하는 경우에는 그러하지 아니하다. <개정 2012.6.1>

② 사업자는 전자서명(「전자서명법」 제2조제2호에 따른 전자서명을 말한다. 이하 같다)을 한 전자문서를 사용하려면 대통령령으로 정하는 바에 따라 그 전자문서의 효력, 수령 절차 및 방법 등을 소비자에게 고지하여야 한다.

③ 사업자는 전자문서를 사용할 때 소비자에게 특정한 전자서명 방법을 이용하도록 강요(특수한 표준 등을 이용함으로써 사실상 특정한 전자서명 방법의 이용이 강제되는 경우를 포함한다)하여서는 아니 되고, 소비자가 선택한 전자서명 방법의 사용을 부당하게 제한하여서는 아니 된다.

④ 전자상거래를 하는 사업자는 소비자의 회원 가입, 계약의 청약, 소비자 관련 정보의 제공 등을 전자문서를 통하여 할 수 있도록 하는 경우에는 회원탈퇴, 청약의 철회, 계약의 해지ㆍ해제ㆍ변경, 정보의 제공 및 이용에 관한 동의의 철회 등도 전자문서를 통하여 할 수 있도록 하여야 한다.

⑤ 전자상거래를 하는 사업자는 소비자가 재화등의 거래와 관련한 확인ㆍ증명을 전자문서로 제공하여 줄 것을 요청한 경우 이에 따라야 한다.

⑥ 전자상거래를 하는 사업자가 전자문서로 제공하기 어려운 기술적 이유나 보안상 이유가 명백하여 이를 소비자에게 미리 고지한 경우에는 제4항과 제5항을 적용하지 아니한다.

⑦ 전자상거래를 하는 사업자가 제4항과 제5항에 따른 의무를 이행할 때 해당 사이버몰의 구축 및 운영과 관련된 사업자들은 그 의무 이행에 필요한 조치를 하는 등 협력하여야 한다.
