정보통신공사업법 시행령 제6조(설계대상인 공사의 범위)
Enforcement Decree of the Information and Communications Works Business Act, Article 6 (Scope of Works Subject to Design)
① 법 제7조에 따라 용역업자에게 설계를 발주해야 하는 공사는 다음 각 호의 어느 하나에 해당하는 공사를 제외한 공사로 한다. <개정 2021.1.5>
(1) Works for which design must be ordered from a service provider pursuant to Article 7 of the Act are works other than the following:
1. 제4조에 따른 경미한 공사
1. Minor works under Article 4
2. 천재ㆍ지변 또는 비상재해로 인한 긴급복구공사 및 그 부대공사
2. Emergency restoration works due to natural disasters or emergency disasters and their ancillary works
3. 별표 1에 따른 통신구설비공사
3. Communications conduit facility works under Attached Table 1
4. 기존 설비를 교체하는 공사로서 설계도면의 새로운 작성이 불필요한 공사
4. Works to replace existing facilities for which new preparation of design drawings is unnecessary
② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 공사로서 별표 6에 따른 기술계 정보통신기술자인 발주자의 소속직원이 관계법령에 따라 설계하는 공사의 경우에는 용역업자에게 발주하지 아니할 수 있되, 그 소속직원은 설계하려는 공사규모에 해당하는 제8조의3제1항에 따른 적합한 기술등급을 보유하여야 한다. 이 경우 제8조의3제1항 각 호 중 "특급감리원"은 "특급기술자"로, "고급감리원 이상의 감리원"은 "고급기술자 이상의 기술자"로, "중급감리원 이상의 감리원"은 "중급기술자 이상의 기술자"로, "초급감리원 이상의 감리원"은 "초급기술자 이상의 기술자"로 본다. <개정 2013.3.23, 2017.7.26, 2019.8.6>
(2) Notwithstanding paragraph (1), for works falling under any of the following that are designed under relevant statutes by an employee of the orderer who is an engineer in the technical field of information and communications under Attached Table 6, the work need not be ordered from a service provider, provided that the employee holds the appropriate technical grade under Article 8-3 (1) corresponding to the scale of the work to be designed. In such cases, in each subparagraph of Article 8-3 (1), "special-grade supervisor" is deemed "special-grade engineer," "supervisor of senior grade or higher" is deemed "engineer of senior grade or higher," "supervisor of intermediate grade or higher" is deemed "engineer of intermediate grade or higher," and "supervisor of junior grade or higher" is deemed "engineer of junior grade or higher":
1. 국방 및 국가안보 등과 관련하여 기밀유지가 요구되는 공사
1. Works requiring confidentiality in connection with national defense and national security, etc.
2. 다음 각 목의 어느 하나에 해당하는 기관이 시행하는 공사
2. Works carried out by any of the following institutions:
가. 국가 및 지방자치단체
(a) The State and local governments
나. 「지방공기업법」에 따른 지방공사
(b) A local public corporation under the Local Public Enterprises Act
다. 그 밖에 정보통신 관련 공공기관으로서 과학기술정보통신부장관이 정하여 고시하는 기관
(c) Other public institutions related to information and communications determined and publicly notified by the Minister of Science and ICT
3. 제1호 및 제2호에 따른 공사 외의 공사로서 총공사금액(도급금액에 발주자가 공급하는 자재비를 포함한 금액을 말한다. 이하 같다)이 1억원 미만인 공사
3. Works other than those under subparagraphs 1 and 2 for which the total construction cost (meaning the contract amount plus the cost of materials supplied by the orderer; the same applies hereinafter) is less than 100 million won
