주차장법 제19조의22(사고 보고 의무 및 사고 조사)

① 기계식주차장관리자등은 그가 관리하는 기계식주차장으로 인하여 이용자가 사망하거나 다치는 사고, 자동차 추락 등 국토교통부령으로 정하는 중대한 사고가 발생한 경우에는 즉시 국토교통부령으로 정하는 바에 따라 관할 시장ㆍ군수 또는 구청장과 「한국교통안전공단법」에 따른 한국교통안전공단의 장에게 통보하여야 한다. 이 경우 「한국교통안전공단법」에 따른 한국교통안전공단의 장은 통보받은 사항 중 중대한 사고에 관한 내용을 국토교통부장관, 제6항에 따른 사고조사위원회에 보고하여야 한다. <개정 2023.8.16>

② 기계식주차장관리자등은 제1항 전단에 따른 중대한 사고가 발생한 경우에는 사고현장 또는 중대한 사고와 관련되는 물건을 이동시키거나 변경 또는 훼손하여서는 아니 된다. 다만, 인명구조 등 긴급한 사유가 있는 경우에는 그러하지 아니하다.

③ 제1항에 따라 통보받은 「한국교통안전공단법」에 따른 한국교통안전공단의 장은 기계식주차장 사고의 재발 방지 및 예방을 위하여 필요하다고 인정하면 기계식주차장 사고의 원인 및 경위 등에 관한 조사를 할 수 있다.

④ 시장ㆍ군수 또는 구청장은 한국교통안전공단의 사고조사가 원활히 진행될 수 있도록 사고조사에 참여하여야 하고, 사고조사에 따른 행정처리 등에 적극 협조하여야 한다. <신설 2023.8.16>

⑤ 「한국교통안전공단법」에 따른 한국교통안전공단의 장은 기계식주차장 사고의 효율적인 조사를 위하여 사고조사반을 둘 수 있으며, 사고조사반의 구성 및 운영 등에 관한 사항은 국토교통부령으로 정한다. <개정 2023.8.16>

⑥ 국토교통부장관은 제3항에 따라 「한국교통안전공단법」에 따른 한국교통안전공단이 조사한 기계식주차장 사고의 원인 등을 조사하고, 재발 방지 방안을 마련하기 위하여 필요한 경우 사고조사위원회를 구성ㆍ운영할 수 있다. <개정 2023.8.16>

⑦ 사고조사위원회는 기계식주차장 사고의 원인 등을 조사하여 원인과 조사한 결과를 국토교통부에 보고하여야 한다. <개정 2023.8.16>
