Act on the Establishment and Operation of Local Medical Centers, Article 22 (Operational Diagnosis and Corrective Measures)

① 보건복지부장관은 제21조제1항 본문에 따라 운영평가를 하거나 같은 조 제3항에 따른 서류 등을 분석한 결과, 지방의료원이 다음 각 호의 어느 하나에 해당되는 경우에는 대통령령으로 정하는 바에 따라 지방의료원에 대한 운영진단을 실시하고 그 결과를 공표할 수 있다. <개정 2015.1.28>

1. 3개 사업연도 이상 계속하여 당기 순손실이 발생한 경우

4. 지방의료원이 수행하는 사업 중 공공보건의료사업이 차지하는 비중이 현저하게 낮은 경우

② 보건복지부장관은 제1항에 따른 운영진단 결과 필요하다고 인정하는 경우에는 지방자치단체의 장 또는 원장에게 해당 지방의료원의 임원의 해임, 조직의 개편 등 운영 개선을 위하여 필요한 조치를 하도록 요청할 수 있다.

③ 제2항에 따른 요청을 받은 지방자치단체의 장 및 원장은 정당한 사유가 없으면 이에 따라야 한다.
