책임운영기관의 설치ㆍ운영에 관한 법률 제20조(기관 간 인사교류)

① 소속책임운영기관과 소속중앙행정기관 및 그 소속 기관 간 공무원의 전보(轉補)가 필요하다고 인정되는 경우에는 소속중앙행정기관의 장이 기관장과 협의하여 실시할 수 있다.

② 제19조에 따라 채용된 소속책임운영기관 소속 경력직공무원이 다른 행정기관의 경력직공무원으로 전보 또는 경력경쟁채용되려면 제1항의 경우 및 해당 인사 관계 법령(전보 또는 경력경쟁채용 직위에 적용되는 법령을 말한다)에서 정한 절차에 따라 임용된 공무원의 경우 외에는 해당 인사 관계 법령에서 정하는 경력경쟁채용시험을 거쳐야 한다. 이 경우 임용예정 직급은 해당 인사 관계 법령을 관장하는 중앙행정기관의 장의 승인을 받아 개별적으로 정한다. <개정 2011.5.23>

③ 다른 법률에 따라 경력직공무원으로 임용된 후 소속책임운영기관으로 전보 또는 경력경쟁채용된 사람이 다시 다른 행정기관의 경력직공무원으로 전보 또는 경력경쟁채용되는 경우에는 제2항을 적용하지 아니한다. 다만, 소속책임운영기관으로 전보 또는 경력경쟁채용된 후 승진 임용된 사람에 대하여는 제2항 후단만 적용한다. <개정 2011.5.23>
