Elementary and Secondary Education Act, Article 20-4 (Individual Educational Support for Students)
(1) Where the head of a school or a teacher determines that a student is disrupting educational activities to the point that classes cannot proceed and that the other students' right to learn needs protection, the head of the school or the teacher may temporarily separate the student and provide individual educational support (hereinafter referred to as "individual educational support"). In such cases, individual educational support shall be used only to the minimum extent necessary, taking into comprehensive account the classroom situation, the particular circumstances of the student, and other factors, and details such as the criteria and methods for applying individual educational support shall be prescribed by Presidential Decree.
(2) The head of a school shall secure the space and personnel needed for individual educational support and shall prepare learning support methods or an individual educational support plan.
(3) Where a teacher has provided individual educational support in a separate space under paragraph (2), the teacher shall report the date, time, and circumstances of the individual educational support to the head of the school, and the head of the school shall inform the guardian of that fact.
(4) Where a student refuses individual educational support, or continues to disrupt educational activities even after individual educational support has been provided several times, and the head of the school determines that the other students' right to learn needs protection, the head of the school may ask the guardian to take the student and have the student study at home. In such cases, the head of the school shall check on the student's home study.
(5) Where requests to the guardian to take the student under paragraph (4) are repeated several times, the head of the school may request support from the Superintendent of Education, taking into comprehensive account the persistence and seriousness of the disruption of educational activities, whether the guardian's refusal to take the student is intentional, the student's home study, and other factors. In such cases, the Superintendent of Education shall, in consultation with the head of the school, prepare support measures so that treatment, counseling, and learning support programs can be provided to the student.
(6) The Superintendent of Education shall provide the funding and personnel needed for individual educational support.
(7) The Superintendent of Education shall survey how individual educational support is being operated every year and shall prepare support measures under paragraph (6).
(8) Except as provided in paragraphs (1) through (7), matters necessary for individual educational support shall be prescribed by Presidential Decree.
