초ㆍ중등교육법 제60조의7(금융정보등의 제공)

① 교육부장관 및 교육감은 제60조의5에 따라 교육비를 지원하는 경우에는 지원 대상 학생 및 그 가구원의 재산을 평가하기 위하여 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제2항에도 불구하고 제60조의6제2항에 따라 제출된 해당 학생 및 그 가구원의 동의 서면을 전자적 형태로 바꾼 문서로 금융회사 등(「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등과 「신용정보의 이용 및 보호에 관한 법률」 제2조제6호에 따른 신용정보집중기관을 말한다. 이하 같다)의 장에게 금융정보ㆍ신용정보 또는 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청할 수 있다. <개정 2013.3.23, 2016.2.3, 2025.3.18>

② 제1항에 따라 금융정보등의 제공을 요청받은 금융회사 등의 장은 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제1항 및 제3항에도 불구하고 명의인의 금융정보등을 제공하여야 한다.

③ 제2항에 따라 금융정보등을 제공한 금융회사 등의 장은 금융정보등의 제공사실을 명의인에게 통보하여야 한다. 다만, 명의인의 동의가 있는 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제7항에도 불구하고 통보하지 아니할 수 있다. <개정 2015.3.11>

④ 제1항 및 제2항에 따른 금융정보등의 제공요청 및 제공은 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망을 이용하여야 한다. 다만, 정보통신망의 손상 등 불가피한 경우에는 그러하지 아니하다.

⑤ 제1항 및 제2항에 따른 업무에 종사하거나 종사하였던 자와 제62조에 따라 권한 등을 위임 또는 위탁받거나 받았던 자는 업무를 수행하면서 취득한 금융정보등을 이 법에서 정한 목적 외의 다른 용도로 사용하거나 다른 사람 또는 기관에 제공하거나 누설하여서는 아니 된다.

⑥ 제1항, 제2항 및 제4항에 따른 금융정보등의 제공요청 및 제공 등에 필요한 사항은 대통령령으로 정한다.
