특허법 시행규칙 제102조(우선권주장의 보정 또는 추가)

①출원인이 우선권주장을 보정 또는 추가하고자 하는 경우에는 우선일부터 1년 4월(우선권주장의 보정 또는 추가로 인하여 우선일이 변경된 경우에는 변경된 우선일부터 1년 4월과 우선일부터 1년 4월중 먼저 만료되는 날)과 국제출원일부터 4월중 늦게 만료되는 날 이내에 보정 또는 추가하여야 한다.

②출원인이 조기국제공개를 신청한 후에 지식재산처장이 제4항의 규정에 의한 보정서를 수령한 경우에는 당해서류는 제출되지 아니한 것으로 본다. 다만, 조기국제공개를 위한 기술적 준비가 완료되기 전에 당해조기국제공개신청을 취하한 경우 그러하지 아니하다. <개정 2006.12.29, 2025.10.1>

③우선권주장의 보정 또는 추가로 인하여 우선일이 변경된 경우 변경전 우선일부터 기산하여 만료되지 아니한 기간은 변경된 우선일부터 그 기간을 기산하여야 한다.

④제1항의 규정에 의한 보정 또는 추가를 하고자 하는 자는 별지 제39호서식의 보정서를 지식재산처장에게 제출하여야 한다. <개정 2001.6.30, 2006.12.29, 2025.10.1>

⑤대리인에 의하여 절차를 밟는 경우에는 제4항의 규정에 의한 보정서에 그 대리권을 증명하는 서류를 첨부하여야 한다. <개정 2006.12.29>
