항만시설관리권 등록령 제54조(저당권의 이전을 목적으로 하는 분할등록)

① 갑 항만시설관리권을 분할하여 그 일부를 을 항만시설관리권으로 한 경우에 을 항만시설관리권만이 저당권의 목적인 경우에는 을 항만시설관리권의 등록용지 중 해당구 사항란에 그 권리에 관한 등록을 옮겨 적고 신청서의 접수연월일과 접수번호를 적은 후 등록공무원이 도장을 찍어야 한다.

② 제1항의 경우에는 갑 항만시설관리권의 등록용지 중 저당권에 관한 등록에 을 항만시설관리권의 표시를 하고, 분할로 인하여 몇호의 항만시설관리권의 등록용지에 옮겨 적은 뜻을 부기한 후 그 등록을 붉은 선으로 지워야 한다.

③ 신청서에 저당권의 등록명의인이 그 권리의 소멸을 승낙한 것을 증명하는 서면 또는 이에 대항할 수 있는 재판의 등본을 첨부한 경우에는 갑 항만시설관리권의 등록용지 중 해당 권리에 관한 등록에 그 뜻을 부기하고 해당 등록을 붉은 선으로 지워야 한다.
