건축사법 시행령 제30조의4(제척, 기피 및 회피)

① 징계위원회의 위원이 다음 각 호의 어느 하나에 해당하는 경우에는 징계위원회의 의결에서 제척된다.

② 징계대상자는 징계위원회의 위원에게 불공정한 의결을 할 염려가 있다고 의심할 만한 상당한 사유가 있는 경우에는 그 사유를 서면으로 소명(疎明)하고 기피 신청을 할 수 있다.

③ 징계위원회는 제2항에 따른 기피 신청을 받았을 때에는 징계위원회의 의결로 해당 위원의 기피 여부를 결정하여야 한다. 이 경우 기피 신청을 받은 위원은 그 의결에 참여하지 못한다.

④ 징계위원회의 위원이 제1항이나 제2항의 사유에 해당하는 경우에는 스스로 그 사건의 의결에서 회피하여야 한다.
