Enforcement Decree of the Act on the Designation and Operation of Free Economic Zones, Article 31 (Delegation of Authority)
① 중앙행정기관의 장은 법 제30조제1항에 따라 다음 각 호의 권한을 시ㆍ도지사에게 위임한다. <개정 2011.8.5, 2021.9.14>
(1) Pursuant to Article 30 (1) of the Act, the head of a central administrative agency delegates the following authority to the Mayor/Do Governor:
1. 법 제7조제1항 또는 제2항에 따른 경제자유구역개발계획의 변경 중 같은 조 제4항에 따른 경미한 사항의 변경
1. Among changes to the free economic zone development plan under Article 7 (1) or (2) of the Act, changes to minor matters under paragraph (4) of the same Article;
2. 법 제7조제3항에 따라 준용되는 법 제4조제8항에 따른 변경 내용의 관보 고시(제1호에 따른 경미한 사항의 변경인 경우로 한정한다)
2. Public notice in the Official Gazette of the changed contents under Article 4 (8) of the Act as applied mutatis mutandis under Article 7 (3) of the Act (limited to changes to minor matters under subparagraph 1);

② 시ㆍ도지사는 제1항제2호에 따라 위임받은 업무를 처리한 때에는 그 업무를 처리한 날부터 10일 이내에 관계 서류의 사본을 산업통상부장관에게 송부하여야 한다. <개정 2011.8.5, 2013.3.23, 2025.5.20, 2025.10.1>
(2) When the Mayor/Do Governor has handled affairs delegated under paragraph (1) 2, the Mayor/Do Governor shall send a copy of the relevant documents to the Minister of Industry and Trade within 10 days from the date the affairs were handled.
③ 시ㆍ도지사는 법 제30조제3항에 따라 다음 각 호의 권한을 경제자유구역청장에게 위임한다. <개정 2011.8.5, 2013.3.23, 2021.9.14, 2025.5.20, 2025.10.1>
(3) Pursuant to Article 30 (3) of the Act, the Mayor/Do Governor delegates the following authority to the Free Economic Zone Authority Head:
1. 법 제7조제1항 후단에 따른 경제자유구역개발계획의 변경 요청
1. Requests for change of the free economic zone development plan under the latter sentence of Article 7 (1) of the Act;
2. 법 제7조제2항에 따른 개발사업시행자의 개발계획 변경 요청의 경유
2. Forwarding of requests for change of the development plan by a development project implementer under Article 7 (2) of the Act;
3. 법 제7조의3 단서에 따른 경제자유구역개발계획 미수립지역에 대한 개발 협의
3. Consultation on development of areas without a free economic zone development plan under the proviso of Article 7-3 of the Act;
4. 법 제7조의4에 따른 경제자유구역 연접 지역의 협의
4. Consultation on areas adjacent to free economic zones under Article 7-4 of the Act;
5. 법 제7조의5제1항에 따른 토지의 형질변경, 건축물의 건축, 공작물의 설치 등의 허가
5. Permits for alteration of the form and quality of land, construction of buildings, installation of structures, etc. under Article 7-5 (1) of the Act;
6. 법 제7조의5제3항에 따른 원상회복 명령
6. Orders for restoration to original condition under Article 7-5 (3) of the Act;
7. 법 제7조의5제4항에 따른 대집행
7. Administrative vicarious execution under Article 7-5 (4) of the Act;
8. 법 제8조의3제1항 및 제2항에 따른 개발사업시행자의 지정
8. Designation of development project implementers under Article 8-3 (1) and (2) of the Act;
9. 법 제8조의3제3항에 따른 산업통상부장관 또는 관계 부처의 장과의 협의
9. Consultation with the Minister of Industry and Trade or the head of a relevant ministry under Article 8-3 (3) of the Act;
10. 법 제8조의3제5항에 따른 개발사업시행자 지정 고시
10. Public notice of designation of development project implementers under Article 8-3 (5) of the Act;
11. 법 제8조의4제2항에 따른 시행명령
11. Implementation orders under Article 8-4 (2) of the Act;

13. Public notice of cancellation of designation and replacement designation of development project implementers under Article 8-5 (4) of the Act;
14. 법 제8조의6제1항에 따른 조성토지의 매도명령 및 통보
14. Orders to sell developed land and notification under Article 8-6 (1) of the Act;
15. 법 제8조의6제4항에 따른 이익 환수
15. Recovery of profits under Article 8-6 (4) of the Act;
16. 법 제9조제1항에 따른 실시계획의 승인과 변경승인
16. Approval and approval of changes of implementation plans under Article 9 (1) of the Act;
17. 법 제9조제2항에 따른 산업통상부장관과의 협의
17. Consultation with the Minister of Industry and Trade under Article 9 (2) of the Act;
18. 법 제9조제3항에 따른 실시계획 승인기한 연장
18. Extension of the implementation plan approval deadline under Article 9 (3) of the Act;
19. 법 제9조제5항에 따른 개발사업시행자와의 협의 및 실시계획에의 반영
19. Consultation with development project implementers and reflection in implementation plans under Article 9 (5) of the Act;
20. 법 제9조의6에 따른 농지전용허가
20. Farmland conversion permits under Article 9-6 of the Act;
21. 법 제10조제1항에 따른 승인ㆍ변경승인의 고시
21. Public notice of approval and approval of changes under Article 10 (1) of the Act;
22. 법 제10조제2항에 따른 열람 제공
22. Provision of inspection under Article 10 (2) of the Act;

25. 법 제23조제2항에 따른 외국인전용 약국의 등록
25. Registration of pharmacies exclusively for foreigners under Article 23 (2) of the Act;
26. 법 제27조의7에 따른 경제자유구역청 회계의 관리
26. Management of accounts of the Free Economic Zone Authority under Article 27-7 of the Act;
27. 법 제28조의2제1항에 따른 보고 및 검사 등
27. Reports and inspections under Article 28-2 (1) of the Act;
28. 법 제28조의5제1항에 따른 청문
28. Hearings under Article 28-5 (1) of the Act;
29. 법 제35조제3항에 따른 과태료의 부과ㆍ징수
29. Imposition and collection of administrative fines under Article 35 (3) of the Act.
④ 제3항에 따라 위임된 사무 중 제8호, 제12호, 제16호 및 제27호의 사무를 처리하는 경우에는 미리 시ㆍ도지사는 경제자유구역청장에게 의견을 제시할 수 있다. <신설 2011.8.5>
(4) When handling affairs among those delegated under paragraph (3) in subparagraphs 8, 12, 16, and 27, the Mayor/Do Governor may present opinions to the Free Economic Zone Authority Head in advance.
