국가공간정보 기본법 시행령 제23조(공간정보의 복제 및 판매 등)

① 관리기관의 장은 법 제34조제1항 본문에 따라 정보이용자에게 제공하려는 공간정보데이터베이스를 해당 기관의 인터넷 홈페이지와 국가공간정보센터를 통하여 공개하여야 한다. <개정 2015.6.1>

② 관리기관(중앙행정기관 및 지방자치단체로 한정한다. 이하 이 항, 제3항, 제4항, 제24조의2 및 제24조의3에서 같다)의 장은 법 제34조제2항에 따라 다음 각 호의 기준을 모두 충족하는 경우에는 공개가 제한된 공간정보를 제공할 수 있다. <신설 2022.3.15>

③ 관리기관의 장은 제2항에 따라 제공하려는 공간정보에 「군사기지 및 군사시설 보호법」에 따른 군사시설, 「접경지역 지원 특별법」에 따른 접경지역의 시설 또는 「보안업무규정」 제32조에 따른 국가보안시설에 관한 정보가 포함된 경우에는 해당 정보의 일부 또는 전부를 삭제하는 등의 방법으로 보안처리하여 제공해야 한다. <신설 2022.3.15>

④ 관리기관의 장은 제2항에 따라 공간정보를 제공할 때 정보통신망을 이용하여 제공하려는 경우에는 공간정보 암호화 등 보안을 위한 기술적 보호조치를 해야 한다. <신설 2022.3.15>

(4) When웬 providing프^r러^v바이딩 geospatial지오스페이실 information인^f퍼메이션 under언더 paragraph패^r러그^r래^f프 (2) through^θ쓰^r루 an앤 information인^f퍼메이션 and앤드 communications커뮤너케이션즈 network,네트워크 the^ð더 head헤드 of어^v브 a어 management매너지먼트 institution인스티투션 shall섈 take테이크 technical텍니클 protective프^r러텍티^v브 measures메저즈 for^f포 security,시큐^r러티 such서치 as애즈 encrypting엥크^r립팅 the^ð더 geospatial지오스페이실 information.인^f퍼메이션

⑤ 법 제34조제4항에 따라 관리기관의 장이 사용료 또는 수수료를 받으려는 경우에는 실비(實費)의 범위에서 정해야 하며, 사용료 또는 수수료를 정하였을 때에는 그 내용을 관보 또는 공보에 고시하고(중앙행정기관 또는 지방자치단체에 한정한다) 해당 기관의 인터넷 홈페이지와 국가공간정보센터를 통하여 공개해야 한다. <개정 2015.6.1, 2022.3.15>

⑥ 관리기관의 장은 공간정보데이터베이스로부터 복제하거나 출력한 자료의 사용이 다음 각 호에 해당하는 경우에는 법 제34조제4항에 따른 사용료 또는 수수료를 감면할 수 있다. <개정 2015.6.1, 2022.3.15>
