국가공무원 복무규정 제13조의2(허가권자)

① 공무국외출장등은 공무국외출장등을 하게 되는 사람(이하 "공무국외출장자등"이라 한다)의 소속 장관(「공무원임용령」 제2조제3호에 따른 소속 장관을 말한다. 다만, 파견 중인 공무원의 경우에는 파견받은 기관의 장을 말한다. 이하 같다)이 허가한다.

② 고위공직자의 국외 출장은 소속 장관이 출국예정 10일(토요일 및 공휴일은 제외한다) 전에 미리 출장 일정, 인적 구성 및 여비내역(이하 "출장일정등"이라 한다)을 구체적으로 밝혀 외교부장관에게 국외 출장의 허가를 요청하고, 외교부장관의 제청으로 국무총리가 허가한다. 다만, 대통령 소속기관의 장의 국외 출장은 대통령이 허가하고, 차관급 상당의 공무원[국무총리 직속 및 소속의 공무원과 외청장(外廳長)은 제외한다]의 국외 출장은 소속 장관이 허가한다.

③ 제2항에 따른 절차를 거칠 시간적 여유가 없는 긴급한 경우에는 소속 장관이 출장일정등을 외교부장관에게 구두로 통보한 후 대통령 또는 국무총리의 허가를 직접 받을 수 있다. 이 경우 소속 장관은 허가를 받은 후 출장일정등을 외교부장관에게 서면으로 통보하여야 한다.
