국가정보원직원법 시행령 제27조의2(직권 면직에 대한 동의 등)

① 법 제21조제2항에 따라 임명권자가 직권 면직에 대한 징계위원회의 동의를 받아야 하는 경우에는 제30조에 따른 관할 징계위원회에 별지 제1호서식의 직권 면직 동의 요구서로 그 동의를 요구해야 한다.

② 제1항에 따른 징계위원회는 다른 징계사건(「국가공무원법」 제78조의3제2항 및 제78조의4제2항에 따라 징계의결이 요구된 사건은 제외한다)에 우선하여 직권 면직에 관한 동의 여부에 대해 의결해야 한다.

③ 제1항에 따른 징계위원회가 직권 면직에 관한 동의 여부에 대해 의결하였을 때에는 지체 없이 별지 제1호의2서식의 직권 면직 동의 의결서를 첨부하여 임명권자에게 통보해야 한다.

④ 제1항부터 제3항까지에서 규정한 사항 외에 직권 면직 대상자의 출석, 위원의 제척ㆍ기피 및 증거조사에 관하여는 제37조, 제38조 및 제40조를 준용한다. 이 경우 "징계 대상자"는 "직권 면직 대상자"로, "징계의결"은 "직권 면직에 대한 동의 의결"로, "징계사건"은 "직권 면직 사건"으로, "징계심사"는 "직권 면직 심사"로 본다.
