외국으로부터의 촉탁에 따른 수탁사항은 대한민국의 법률에 의하여 이를 실시한다. 다만, 외국법원이 특정방식에 의한 실시를 요청하는 경우 그 방식이 대한민국의 법률에 저촉되지 아니하는 때에는 그 방식에 의한다.
