국회법 제114조(기명투표ㆍ무기명투표 절차)

① 기명투표 또는 무기명투표를 할 때에는 각 의원은 먼저 명패를 명패함에 넣고, 다음에 투표용지를 투표함에 넣는다.

② 기명투표 또는 무기명투표를 할 때에는 의장은 의원 중에서 몇 명의 감표위원(監票委員)을 지명하고 그 위원의 참여하에 직원으로 하여금 명패와 기명투표ㆍ무기명투표의 수를 점검ㆍ계산하게 한다. 이 경우 감표위원으로 지명된 의원이 이에 응하지 아니할 때에는 그 의원을 제외하거나 다른 의원을 감표위원으로 지명할 수 있다.

③ 투표의 수가 명패의 수보다 많을 때에는 재투표를 한다. 다만, 투표의 결과에 영향을 미치지 아니할 때에는 그러하지 아니하다.
