군복 및 군용장구의 단속에 관한 법률 제3조(제조ㆍ판매의 허가)

①군복 또는 군용장구의 제조 또는 판매업(이하 "제조ㆍ판매업"이라 한다)을 하고자 하는 자는 대통령령이 정하는 시설을 갖추고, 제조 또는 판매하고자 하는 군복 또는 군용장구의 종류를 정하여 국방부장관의 허가를 받아야 한다. 허가받은 군복 또는 군용장구의 종류를 변경하는 경우도 또한 같다.

② 국방부장관은 제1항에 따른 허가 또는 변경허가의 신청을 받은 날부터 40일 이내에 허가 여부를 신청인에게 통지하여야 한다. <신설 2018.3.20>

③ 국방부장관이 제2항에서 정한 기간 내에 허가 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가를 한 것으로 본다. <신설 2018.3.20>

④제1항에 따른 허가에는 필요한 조건을 붙일 수 있다. <개정 2018.3.20>

⑤제4항에 따른 조건, 그 밖에 허가 등에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2018.3.20>
