군교도관과 교도병은 소장의 명령 없이 법 제87조에 따른 강제력을 행사해서는 아니 된다. 다만, 그 명령을 받을 시간적 여유가 없는 경우에는 강제력을 행사한 후 소장에게 즉시 보고하여야 한다.
