군에서의 형의 집행 및 군수용자의 처우에 관한 법률 시행령 제14조(신입자 등의 인수)

① 소장은 군사법원, 군검찰부, 군사경찰부대 등에서 처음으로 군교정시설에 수용되는 사람(이하 "신입자"라 한다)이나 다른 군교정시설로부터 이송(移送)되어 온 사람(이하 "이입자"라 한다)을 인수하였을 때에는 호송인(護送人)에게 인수서를 써 주어야 한다. 이 경우 신입자나 이입자에게 부상이나 질병, 그 밖에 건강에 이상이 있을 때에는 호송인으로부터 그 사실에 대한 확인서를 받아야 한다. <개정 2020.2.4>

② 신입자나 이입자를 인수한 군교도관은 제1항 전단의 인수서에 성명, 나이 및 인수 일시를 적고 서명 또는 날인하여야 한다.

③ 소장은 제1항 후단에 따라 확인서를 받았을 때에는 호송인에게 신입자나 이입자의 성명, 나이, 인계 일시 및 부상의 정도나 질병의 상태 등에 관한 사실을 적고 서명 또는 날인하도록 하여야 한다.

④ 소장은 신입자나 이입자가 감염병(「감염병의 예방 및 관리에 관한 법률」 제2조제2호에 따른 감염병을 말한다. 이하 같다)에 걸린 때에는 인수를 거부할 수 있다. 이 경우 수용을 지휘한 군검사와 소속 부대장 또는 이송 보낸 소장에게 즉시 그 사유를 통보하고 국방부장관에게 보고하여야 한다. <개정 2010.12.29, 2022.6.30>

⑤ 소장은 제4항에도 불구하고 감염병에 걸린 신입자나 이입자가 위독하여 다른 곳으로 이송할 만한 시간적 여유가 없을 때에는 그를 격리수용하고 즉시 필요한 조치를 하여야 한다. <개정 2010.12.29>
