기초학력 보장법 제5조(기초학력 보장 종합계획의 수립 등)

① 교육부장관은 관계 중앙행정기관의 장 및 특별시ㆍ광역시ㆍ특별자치시ㆍ도ㆍ특별자치도의 교육감(이하 "교육감"이라 한다)과 협의한 후 제6조에 따른 기초학력 보장위원회의 심의를 거쳐 5년마다 기초학력 보장 종합계획(이하 "종합계획"이라 한다)을 수립하여야 한다. 종합계획 중 대통령령으로 정하는 중요사항을 변경하는 경우에도 또한 같다.

② 교육감은 종합계획의 내용과 해당 지역의 여건을 고려하여 매년 시ㆍ도 기초학력 보장 시행계획(이하 "시행계획"이라 한다)을 수립ㆍ시행하여야 한다.

③ 교육감은 전년도 시행계획에 따른 추진실적과 다음 연도 시행계획을 대통령령으로 정하는 바에 따라 매년 교육부장관에게 제출하여야 한다.

④ 그 밖에 종합계획과 시행계획의 수립 및 시행 등에 필요한 사항은 대통령령으로 정한다.
