내수면어업법 시행령 제12조(공익을 위한 어업의 제한 등)

① 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 법 제16조에 따라 면허ㆍ허가 또는 신고한 어업에 대하여 어업의 제한 등을 하려는 경우에는 법 제10조제4항에 따른 내수면어업조정협의회의 심의를 거쳐야 한다. 이 경우 법 제10조제5항에 따라 수산조정위원회가 내수면어업조정협의회의 기능을 수행할 때에는 해당 수산조정위원회의 심의를 거쳐야 한다.

② 관계 행정기관의 장이 법 제16조제2항에 따라 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 어업의 제한 등을 요청하려는 경우에는 다음 각 호의 사항을 적어 필요한 조치를 요청하여야 한다. <개정 2014.11.11, 2015.12.30>

③ 관계 행정기관의 장은 제2항에 따른 요청을 할 때에는 필요한 어업권 등에 관한 자료를 제출하도록 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 요구할 수 있다. 이 경우 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 특별한 이유가 없으면 이에 따라야 한다.

④ 제2항의 요청을 받은 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 요청된 조치사항에 대한 의견을 관계 행정기관의 장 및 어업권자에게 알려야 한다.

⑤ 특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제4항에 따른 의견을 결정할 때에 조치사항의 결정기준과 그 이행절차 등에 관하여 필요한 사항은 해양수산부령으로 정한다. <개정 2013.3.23>
