도시 및 주거환경정비법 제33조(추진위원회의 조직)

① 추진위원회는 추진위원회를 대표하는 추진위원장 1명과 감사를 두어야 한다.

② 추진위원의 선출에 관한 선거관리는 제41조제3항을 준용한다. 이 경우 "조합"은 "추진위원회"로, "조합임원"은 "추진위원"으로 본다.

③ 토지등소유자는 제34조에 따른 추진위원회의 운영규정에 따라 추진위원회에 추진위원의 교체 및 해임을 요구할 수 있으며, 추진위원장이 사임, 해임, 임기만료, 그 밖에 불가피한 사유 등으로 직무를 수행할 수 없는 때부터 6개월 이상 선임되지 아니한 경우 그 업무의 대행에 관하여는 제41조제5항 단서를 준용한다. 이 경우 "조합임원"은 "추진위원장"으로 본다.

④ 제3항에 따른 추진위원의 교체ㆍ해임 절차 등에 필요한 사항은 제34조제1항에 따른 운영규정에 따른다.

⑤ 추진위원의 결격사유는 제43조제1항부터 제3항까지를 준용한다. 이 경우 "조합"은 "추진위원회"로, "조합임원"은 "추진위원"으로, "제35조에 따른 조합설립 인가권자"는 "제31조에 따른 추진위원회 승인권자"로 본다. <개정 2023.7.18>
