Enforcement Decree of the Act on the Protection and Utilization of Cultural Heritage, Article 48 (Criteria for Imposition of Administrative Fines)

① 법 제103조에 따른 과태료의 부과기준은 별표 4와 같다. <개정 2019.12.31>

② 국가유산청장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 위반행위의 동기, 내용, 횟수 및 위반의 정도 등을 고려하여 제1항의 기준에 따른 과태료 금액의 2분의 1의 범위에서 그 금액을 가중하거나 감경할 수 있다. 다만, 가중하는 경우에도 과태료 총액은 법 제103조에 따른 과태료의 상한액을 초과할 수 없다. <개정 2024.5.7>

③ 국가유산청장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 고의 또는 중과실이 없는 위반행위자(법 제103조제4항제4호부터 제6호까지 및 제8호에 해당하는 자로 한정한다)가 「소상공인기본법」 제2조에 따른 소상공인에 해당하고, 과태료를 체납하고 있지 않은 경우에는 다음 각 호의 사항을 고려하여 별표 4에 따른 과태료의 100분의 70 범위에서 그 금액을 줄여 부과할 수 있다. 다만, 제2항 본문에 따른 감경과 중복하여 적용하지 않는다. <신설 2023.4.25, 2024.5.7>
