부동산등기법 제44조(건물의 부존재)

① 존재하지 아니하는 건물에 대한 등기가 있을 때에는 그 소유권의 등기명의인은 지체 없이 그 건물의 멸실등기를 신청하여야 한다.

② 그 건물 소유권의 등기명의인이 제1항에 따라 등기를 신청하지 아니하는 경우에는 제43조제2항을 준용한다.

③ 존재하지 아니하는 건물이 구분건물인 경우에는 제43조제3항을 준용한다.
