부동산등기법 제55조(사망 등으로 인한 권리의 소멸과 말소등기)

등기명의인인 사람의 사망 또는 법인의 해산으로 권리가 소멸한다는 약정이 등기되어 있는 경우에 사람의 사망 또는 법인의 해산으로 그 권리가 소멸하였을 때에는, 등기권리자는 그 사실을 증명하여 단독으로 해당 등기의 말소를 신청할 수 있다.
