수도권정비계획법 시행령 제17조(과밀부담금의 감면)

1. 국가나 지방자치단체가 건축하는 건축물에는 부담금을 부과하지 아니한다.

2. 「도시 및 주거환경정비법」에 따른 재개발사업으로 건축하는 건축물에는 부담금의 100분의 50을 감면한다.

3. 건축물 중 주차장, 주택, 「영유아보육법」 제10조제4호에 따른 직장어린이집 및 국가나 지방자치단체에 기부채납되는 시설에 대하여는 별표 2에서 정하는 바에 따라 부담금을 감면한다.

4. 건축물 중 수도권만을 관할하는 공공법인(지점을 포함한다)의 사무소에 대하여는 부담금을 부과하지 아니한다.

5. 「건축법 시행령」 별표 1 제10호마목에 따른 연구소 중 다음 각 호의 어느 하나에 해당하는 단지에 건축하는 연구소에 대하여는 별표 2에서 정하는 바에 따라 부담금을 감면한다.

6. 「금융중심지의 조성과 발전에 관한 법률」 제2조에 따른 금융중심지에 건축하는 「건축법 시행령」 별표 1 제14호나목의 일반업무시설 중 금융업소에 대하여는 별표 2에서 정하는 바에 따라 부담금을 감면한다.

7. 건축물 중 부담금이 부과된 시설을 용도변경하는 경우에는 부담금을 부과하지 아니한다.
